Plea deal nixed after party pics

Plea deal is off after accused seen partying:
17-year-old Michael Ramirez of New Hampshire was charged with two counts of vehicular assault after speeding, losing control of his car and slamming headlong into an SUV. His passenger, 16-year-old Nathan Hergenhahn, died at the scene. Prosecutors had reached a plea agreement. However pictures of Ramirez partying on MySpace have surfaced and the plea has been withdrawn.

Under the plea deal, Ramirez would have received a deferred sentence, seven years’ loss of license and 1,032 hours of community service, Shepherd said.

Earlier this month, Judge William Groff rejected the plea bargain and it was going to be resubmitted yesterday. Instead, the prosecution withdrew the plea bargain after receiving input from Hergenhahn’s family.

The family, which had originally been in favor of the plea bargain, withdrew its support after seeing the photographs depicting Ramirez at a party on Myspace.com.

“The family thought he was remorseful,” Shepherd said. “Obviously the family is just devastated. They’re grieving and then they saw those photos.”

Even with a trial the most he is looking at is one year behind bars.

Prosecutor asks judge to revoke bail of alleged sex predator:
Finally someone in the Connecticut legal system has some sense. The assistant state’s attorney handling the case of alleged serial predator Scott Shefelbine is trying to have his bail revoked on the grounds he violated his terms of release. He’s been arrested multiple times for various sex offenses usually involving MySpace. His parents have paid his bail each time racking up to a whopping $1.5M.

My only question is what took you so long?

A judge will rule on the motion July 10th.

The other man who had sex with Tammy Tokes' daughter pleads guilty

Man in MySpace teen sex case pleads guilty:
One of the men who had sex with the infamous daughter of Tammy Tokes has pleaded guilty.

The final defendant in an underage sex case involving a 14-year-old Utica teen pleaded guilty Monday to having sex with the girl, who is pregnant.

Chris Garcia, 21, pleaded guilty to two counts of third-degree criminal sexual conduct and failure to register as a sexual offender.

“He admitted to his guilt,” said defense attorney Robert Plumpe.

“He wants to move on with his life.”

The girl, who is in foster care, gained national attention last year for running away with a man she met on MySpace. Her mother, Tammy Fennell, pleaded guilty last month to fourth-degree child abuse for allowing her 14-year-old daughter to have sex with two men, including Garcia.

Fennell had allowed Garcia and a second man, James Przeadzki, to live in her Utica Manor apartment with her daughter. Fennell once called herself “Tammy Tokes” on her MySpace Web site and bragged about a life of drinking, pot smoking and debauchery.

Garcia, who is being held in the Macomb County Jail on $1 million bond, will be sentenced July 23 by Macomb Circuit Judge Matthew Switalski. He could face up to 15 years in prison.

Once Child Protective Services found out about the girl’s pregnancy, Utica Police began investigating. Officials said the girl and Garcia have had a relationship since last year. During the the relationship, he would pick her up from school and tell school officials that he was her fiance.

After Garcia pleaded guilty, Switalski asked him questions about the case, including if he had sex with the 14-year-old.

Garcia responded “multiple times.”

Sentencing is set for July 23rd.

Holland man suspected of using MySpace to lure teen:
So this guy, 22-year-old Edward Lara-Gutierrez from Holland, MI, travels to Tempe, AZ to have sex with a 16-year-old boy he met on MySpace. Unfortunately it was not one of those Dateline NBC moments.

Once Lara-Gutierrez arrived in Arizona, he met the victim’s parents. He told them they would be hanging out at a friend’s house for the weekend. Police said he and the victim instead went to a Tempe hotel, where they had sexual contact.

The Victim called his parents from the hotel on Saturday and told them what happened.
The parents then called the police, Horn said. The case is still under investigation, he said.

He lied to the parents about his age and I’m guessing a few other things.

Underwood discussed cannibalism

Prosecutors allege Underwood discussed cannibalism:
For those of you new top the party Kevin Ray Underwood was arrested in the death of 10-year-old Jamie Rose Bolin. He killed her, sexually assaulted her (in that order), and then was preparing to consume her flesh. The reason he landed here is because after he killed her and while the police were looking for her Underwood just casually logged into his MySpace and Blogger accounts.

It’s no secret that Underwood had an obsession with cannibalism. It seems that it was about as far as a secret that you can get…

The claims about Kevin Ray Underwood’s behavior are contained in a witness summary report filed by prosecutors prior to a hearing yesterday in McClain County District Court.

According to the report, Underwood talked to a childhood friend about cannibalism and also talked to a worker at an Oklahoma City haircut shop about cooking organs.

Way to keep it to yourself there Hannibal. I hope your taste for flesh is worth the needle.

Women Arrested, Accused Of Bathroom Sex In Front Of Children:

Emily Hernandez and Johannie Jimenez from Seminole County, Florida were arrested for having hot girl on girl action…in a public restroom…at a park…in front of children…while a third woman filmed it.

A woman told police that she was walking into the bathroom with her children, and noticed Hernandez and Jimenez naked and apparently performing oral sex. She said another woman was photographing the acts.

The pregnant mother said she tried to leave the area with her children but the women would not let her leave. She said she was threatened not to call the police.

The woman eventually left the area with her children unharmed, police said.

Hernandez and Jimenez face lewd and lascivious exhibition charges as well as battery on a pregnant person, false imprisonment of an adult and child under 13 years old.

While the women were being transported to the Seminole County Jail, an officer said that Hernandez apparently bit Jimenez inside the patrol car, according to the police report.

MySpace bashing accused bailed:
17-year-old Kael Haynes Turner from Australia was granted bail in Brisbane Supreme Court recently. He had spent 54 days in custody for a series of crimes. He was part of a group of kids that called themselves GC Rydhaz, GC standing for Gold Coast. The GC Rydhaz went on a spree where they would assault their victims then steal their wallets, cell phones, or iPods. The biggest story going around the crime blogs right now is the disappearance of Jessie Davis, the woman missing from Canton, Ohio who was 9-months pregnant. Her body has been found and police have arrested her boyfriend Bobby Cutts Jr.

Conn. SO arrested for MySpace profile

Second man accused of parole violation by posting MySpace profile:
21-year-old William Santos of Waterbury, CT was arrested for violating his parole by having a MySpace profile. Santos is a convicted sex offender. Of course Connecticut Attorney General Richard Blumenthal uses this one arrest to pat himself on the back.

“This arrest demonstrates that many of these convicted sex offenders are violating their parole and socializing in the same space as millions of children,” Blumenthal said. “As astonishing and appalling as the discovery of thousands of sex offenders on MySpace, these convicted felons using their real names are only the tip of the predator iceberg.”

Tip of the iceberg is an understatement. Yet while Mr. Blumenthal breaks his arm trying to pat himself on the back Connecticut is home to the two of the most prolific MySpace predators David Leonard and Scott Shfelbine. Both have had multiple sexually related arrests and one of them is even walking free right now. What’s being done about men like that Mr. Blumenthal?
